Trademark & Copyright Protection Notice

PT BW Hospitality Indonesia (“BW Hospitality”), a limited liability company established under the laws of the Republic of Indonesia and the rightful and exclusive owner of the registered trademarks “BW Hospitality” and its entire derivative brands, including but not limited to its hotel business units under its management, namely BW Luxury Jambi, BW Suite Belitung, BW Inn Belitung, and BW Express Jakarta, hereby issues this official notice and warning to the general public, business partners, and all relevant stakeholders as follows:

1. Exclusive Rights Ownership

BW Hospitality is the legitimate and exclusive rights holder of the “BW Hospitality” trademark and all of its derivative brand identities used in the hospitality business sector across Indonesia.

All trademarks, trade names, logos, visual identities, and commercial elements associated with BW Hospitality and its affiliated hotel units have been duly registered and/or legally used in accordance with the prevailing laws and regulations of the Republic of Indonesia, including Law No. 20 of 2016 on Trademarks and Geographical Indications as amended by Law No. 11 of 2020 on Job Creation.

Accordingly, no party is permitted to use, reproduce, imitate, modify, or exploit the “BW Hospitality” trademark and/or any of its derivatives for any purpose whatsoever without prior written authorization from BW Hospitality management.

Any unauthorized use of these trademarks constitutes a violation of applicable laws and may result in legal action.

2. Brand Reputation

The “BW Hospitality” brand and its affiliated hotel units are recognized as part of Indonesia's growing hospitality industry, known for professional service standards, modern hospitality experiences, and a consistent commitment to guest satisfaction.

This reputation has been built through long-term dedication, service excellence, and the trust of guests, business partners, and stakeholders across various operational regions.

Therefore, the “BW Hospitality” name is not merely a business identity but a protected asset reflecting brand integrity and reputation.

3. Infringement by Unauthorized Parties

From time to time, BW Hospitality has identified instances of unauthorized use of names, logos, and brand elements that are identical or substantially similar to the “BW Hospitality” trademark by irresponsible parties.

Such findings have been observed through both social media monitoring and field investigations, potentially causing public confusion and creating a false impression of affiliation or official partnership that does not exist.

These actions may cause material and immaterial harm to BW Hospitality and mislead the public, particularly consumers who may be deceived by such unauthorized representations.

Such conduct may constitute violations of trademark law, unlawful acts, and breaches of consumer protection rights as regulated under Law No. 8 of 1999 on Consumer Protection.

BW Hospitality therefore urges all business operators and relevant parties to act in good faith and respect intellectual property rights protected under applicable laws.

4. Legal Consequences

For any infringement of BW Hospitality's trademark rights, the company reserves the full right to pursue legal enforcement measures, both civil and criminal.

BW Hospitality may file lawsuits for trademark infringement and/or report such violations to law enforcement authorities in accordance with Article 100 of Law No. 20 of 2016 on Trademarks and Geographical Indications.

Such infringements may carry criminal penalties of up to five (5) years imprisonment and/or fines of up to IDR 2,000,000,000 (two billion rupiah), as well as other sanctions provided under applicable laws and regulations.

In this regard, BW Hospitality hereby STRICTLY DEMANDS all unauthorized parties to:

  1. Immediately cease all use of the “BW Hospitality” name, logo, and/or any similar or derivative brand elements.
  2. Stop all promotional activities, both printed and digital, that use such brand identity.
  3. Change any business, product, or service names that may cause confusion or similarity with BW Hospitality brands.
  4. Destroy all promotional materials, both printed and electronic, within seven (7) calendar days from the publication of this notice.
Failure to comply within the specified timeframe will result in further legal action without additional notice.

5. Public Advisory

BW Hospitality also advises the public, guests, and business partners to exercise caution regarding any information, offers, or activities claiming affiliation with BW Hospitality without official verification.

The public is strongly encouraged to verify all official information through the company's authorized channels before engaging in any transaction or cooperation.

For official information regarding services, hotel units, and promotions under BW Hospitality, please refer only to the company's official communication channels.

BW Hospitality shall not be held responsible for any losses arising from actions taken by unauthorized parties using the company's name or identity without permission.
